Terms of Service
These terms form the agreement between Toddlers Nursery and your family. Please read them carefully before enrolling your child. By using our services, you agree to these terms.

About Toddlers Nursery
Toddlers Nursery & Pre-School is an Ofsted-registered early years childcare provider operating at 1 Warrington Street, OL6 6XB, Ashton Under Lyne. We provide childcare and early education for children aged 9 months to 5 years, guided by the Early Years Foundation Stage (EYFS) Statutory Framework.
We are open Monday to Friday, 07:30 โ 18:00 throughout the year, including during school holiday periods. We are closed on Bank Holidays and between Christmas and New Year (specific closure dates are communicated to families in advance).
Enrolment & Admissions
Places at Toddlers Nursery are offered subject to availability on a first-come, first-served basis. A place is only confirmed once the following have been completed:
- A completed registration form and all required child and family information
- Signature of our Terms and Conditions
- Payment of any applicable deposit (where required)
- Completion of settling-in sessions as agreed with the nursery manager
We reserve the right to decline admission or withdraw a place in exceptional circumstances, including where we are unable to meet a child's specific needs safely, or where the conduct of a parent or carer is deemed incompatible with the nursery's values.
All sessions are allocated on a regular weekly basis. Ad hoc or emergency sessions may be available but cannot be guaranteed.
Fees & Payments
Our current fee structure is available on request and in our downloadable fee sheet. All fees are reviewed annually and families will be given at least 4 weeks' written notice of any changes.

Fees are payable monthly in advance on or before the 1st of each month. Accepted payment methods include bank transfer and Tax-Free Childcare. We do not accept cash as a primary payment method.
- Fees are charged for all contracted sessions, including periods of holiday and sickness absence
- Bank holidays and nursery closure days are not charged
- A late payment fee of ยฃ10 may be applied if fees remain unpaid after 7 days
- Persistent non-payment may result in suspension or termination of the nursery place
Government Funded Hours
We are proud to offer the 15-hour and 30-hour government funded childcare entitlements for eligible children, funded by Tameside Council. Funding is offered in two session formats:
- Option 1: 9:00am โ 4:30pm, three days per week
- Option 2: 9:30am โ 3:00pm, four days per week
Funding is available all year round. The actual funded hours per week may be slightly less than 15 or 30 hours as the entitlement is spread across the full year (including nursery closures).
It is the parent's responsibility to apply for funding codes and ensure they are submitted to the nursery before the relevant term deadline. Toddlers Nursery cannot backdate funding claims.
Attendance & Absence
Regular attendance is vital for your child's development, wellbeing, and social relationships. We ask all families to:
- Notify the nursery by 9:00am on any day your child will be absent
- Inform us of the reason for absence, particularly if it relates to illness
- Ensure your child is collected on time at the end of their session
Children must be collected by an authorised adult as named on the registration form. For safety reasons, we cannot release children to anyone not listed as an authorised collector. If there are custody or court order arrangements in place, please inform us in writing.
If a child is not collected within 30 minutes of their session end time without prior notice, we will follow our Uncollected Child Policy and attempt to contact all emergency contacts listed.
Health & Medication
Your child's health and safety are our highest priority. Please keep your child at home if they are unwell or contagious. As a general guide, children should stay home for:
- Sickness and/or diarrhoea โ until 48 hours after the last episode
- Chickenpox โ until all spots have crusted over
- Antibiotics โ 48 hours from the first dose before returning
- COVID-19, Scarlet Fever, Impetigo, or other notifiable conditions โ as per NHS guidance
If your child requires prescribed medication during nursery hours, you must:
- Provide the original medication with the pharmacy label clearly showing your child's name, dosage, and prescribing GP
- Complete and sign a Medication Consent Form before any medicine is administered
- Inform staff of any known allergies, medical conditions, or changes to your child's health
Where a child has an ongoing medical need, a personalised Health Care Plan will be created in partnership with the family. All our staff hold up-to-date Paediatric First Aid certificates.
Safeguarding & Child Protection
Safeguarding the welfare of every child in our care is our primary legal and moral duty. We follow the Tameside Safeguarding Children Partnership procedures and are required by law to:
- Report any concerns about a child's welfare or safety to Children's Services or the Police
- Follow strict Prevent and radicalisation safeguarding duties
- Maintain up-to-date DBS Enhanced Disclosure checks for all staff and volunteers
- Ensure our Designated Safeguarding Lead (DSL) is available and trained at all times
Our Designated Safeguarding Lead is Melanie (Director). In certain safeguarding circumstances, we are legally obliged to share information without parental consent. Data protection legislation does not override our safeguarding duties.
Notice Periods & Changes to Sessions
We require the following notice periods in writing (by email to ashton@toddlersnursery.uk):
- Withdrawing your child โ at least 4 weeks' written notice from any date. Fees remain payable during the notice period.
- Reducing or changing sessions โ at least 4 weeks' written notice. Changes are subject to availability.
- Increasing sessions โ subject to availability. We will confirm in writing once a place can be guaranteed.
Toddlers Nursery reserves the right to terminate a place with appropriate notice if fees remain unpaid, or if a family's conduct is deemed incompatible with the safe and respectful running of the nursery. In cases involving safeguarding, a place may be suspended immediately.
Conduct, Inclusion & Behaviour
Toddlers Nursery is committed to a warm, inclusive, and respectful environment for all children, families, and staff. We expect all adults on our premises or in contact with our team to treat staff with courtesy and respect.
- Aggressive, abusive, or threatening behaviour toward staff will not be tolerated and may result in a place being terminated
- We operate a strict no-smoking policy on all nursery premises and in all outdoor areas
- Mobile phones should be kept away during drop-off and collection to ensure children's safety and focus
- Photography or filming on nursery premises is not permitted without prior written consent from the nursery manager
For children's behaviour, we follow a positive behaviour approach in line with our Behaviour Policy, which is available on request. We work in partnership with families to support any behavioural challenges in a respectful, child-centred way.
Liability
Toddlers Nursery holds full public liability insurance and takes every reasonable precaution to ensure the safety and wellbeing of children in our care. However:
- We are not responsible for personal belongings brought to the nursery. We ask that labelled, essential items only are brought in.
- We carry out regular risk assessments of all indoor and outdoor areas and activities
- In the event of an accident or incident, families will be informed in writing on the same day
Nothing in these terms limits our liability for death, personal injury caused by negligence, or any other liability that cannot be lawfully excluded.
Changes to These Terms
We reserve the right to update these Terms of Service at any time. Where changes are material, we will give families at least 4 weeks' written notice before the updated terms take effect.
Continued use of our nursery services after that date constitutes your acceptance of the updated terms. The most current version of these terms will always be available on our website and at the nursery reception.
These Terms of Service are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
