Who We Are

Toddlers Nursery & Pre-School ("we", "us", "our") is an early years childcare provider registered and operating at 1 Warrington Street, OL6 6XB, Ashton Under Lyne. We are registered with Ofsted and operate in accordance with the Early Years Foundation Stage (EYFS) Statutory Framework.

For the purposes of UK data protection law (UK GDPR and the Data Protection Act 2018), Toddlers Nursery is the Data Controller for the personal information we hold about children, their families, and our staff.

Data We Collect

To provide a safe and high-quality childcare experience, we collect the following categories of information:

About children:

  • Full name, date of birth, gender, and home address
  • Emergency contact details and parental/guardian information
  • Health and medical information, including allergies, dietary needs, and prescribed medications
  • Development observations, learning journals, and progress records (in line with EYFS)
  • Photographs and videos taken during nursery activities (with consent)
  • Attendance records and session hours

About parents & guardians:

  • Name, address, phone number, and email address
  • Funding eligibility details (e.g. 15 or 30 hours government funding codes)
  • Payment and fee information
  • Correspondence, tour booking details, and enquiry records

How We Use Your Data

We use the personal information we collect for the following purposes:

  • Delivering safe, nurturing, and effective childcare and education
  • Monitoring each child's development and planning activities tailored to their individual needs
  • Managing admissions, funding claims, fee collection, and attendance records
  • Communicating with parents and guardians about their child's progress and nursery updates
  • Meeting our legal safeguarding obligations and sharing relevant information with Ofsted or statutory agencies when required
  • Responding to tour enquiries and admissions requests
  • Keeping our premises and children safe, including CCTV monitoring

Sharing Your Data

We will never sell your personal data. We may share information with the following parties only where necessary and lawful:

  • Ofsted โ€” as required by our registration and inspection obligations
  • Tameside Local Authority โ€” for funding claims, the Early Help Hub, and SEND referrals
  • NHS and healthcare professionals โ€” where a child has health needs that require professional input
  • Safeguarding agencies โ€” including Children's Services, if we have a legal duty to raise a concern
  • Our software providers โ€” such as our nursery management system, who process data on our behalf under data processing agreements
๐Ÿ“‹ All third-party providers are assessed to ensure they meet UK GDPR standards before we share any personal data with them.

Data Retention

We retain personal data only for as long as is necessary for the purpose it was collected, or as required by law:

  • Children's care and development records are retained for 3 years after they leave the nursery
  • Accident and incident records are kept for a minimum of 21 years from the date of the incident
  • Medication records are kept for a minimum of 3 years
  • Financial records (including fee payments and funding) are retained for 7 years
  • Tour enquiry data is retained for 12 months if a placement was not taken up
  • CCTV footage is typically overwritten after 30 days, unless required for an investigation

After these periods, personal data is securely deleted or anonymised.

Your Rights

Under UK GDPR, you have the following rights in relation to your personal data and your child's data:

  • Right of access โ€” you can request a copy of the personal data we hold about you or your child
  • Right to rectification โ€” you can ask us to correct inaccurate or incomplete data
  • Right to erasure โ€” in certain circumstances, you can ask us to delete your data
  • Right to restrict processing โ€” you can ask us to limit how we use your data
  • Right to object โ€” you can object to processing based on legitimate interests
  • Right to withdraw consent โ€” where we rely on consent (e.g. photographs), you can withdraw this at any time
  • Right to complain โ€” you have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk or call 0303 123 1113

Safeguarding & CCTV

The safety of the children in our care is our highest priority. As a registered childcare provider, we have a legal duty to report any concerns about a child's welfare to the appropriate authorities. In such cases, data protection law does not prevent us from sharing information where it is necessary to protect a child.

Our nursery premises are monitored by CCTV for the safety and security of children, staff, and visitors. CCTV footage is securely stored, access-restricted, and not shared except in the event of an investigation by police or other statutory authorities.
